CLIENT TERMS & CONDITIONS
1. General Information
All enquiries relating to services provided by JMack Health Personal Training (“the Trainer”) should be sent to: jmack.health@gmail.com
It is your responsibility to read and understand these terms before signing. You may seek independent legal advice if necessary.
Not enforcing any part of this agreement does not waive the Trainer's rights.
If any clause is found invalid or unenforceable, the rest of the agreement remains in effect.
2. What You Can Expect from Your Trainer
The Trainer will:
Design training sessions based on your goals, fitness level, injuries, or limitations.
Provide coaching, supervision, and support to train safely and effectively.
Prepare, update, and adapt training programs as needed.
Provide copies of your training program via email upon request.
Monitor progress and adjust programs accordingly.
Keep your personal information confidential, except if required for health or safety reasons.
Offer general nutrition guidance only (not a substitute for professional medical advice).
Conduct sessions for 45 minutes, unless otherwise agreed.
Maintain communication outside of sessions if needed to monitor progress.
3. Your Responsibilities as the Client
You agree to:
Provide honest and accurate information during assessments and update the Trainer of any health changes.
Seek medical clearance if recommended by the Trainer.
Participate in assessments and any screening required to ensure your safety.
Arrive on time and wear appropriate clothing and clean, supportive footwear.
Bring any necessary medication or medical equipment.
Take responsibility for maintaining and tracking your training program if done outside the Trainer's facility.
4. Health Screening & Referrals
All clients must complete an initial assessment before starting training.
If the Trainer recommends consulting a medical or allied health professional, it is your responsibility to follow up.
The Trainer may refuse service if training is deemed unsafe. The Late Cancellation Policy may apply in such cases.
5. Cancellations, Rescheduling & Lateness
8 hours' notice is required to cancel or reschedule a session without charge.
Notice must be given in person, via text, or email.
Late cancellations (less than 8 hours' notice) will be charged in full, unless the Trainer waives the fee.
If the Trainer cancels, they will offer either:
Another Trainer to conduct your session (with your approval), or
A rescheduled session.
Late arrival by the client: session ends at the scheduled time.
Late arrival by the Trainer: extra time or partial refund/credit will be applied.
You must immediately inform the Trainer if you experience discomfort, risk of injury, or dissatisfaction.
6. Payments
A. Up-Front Payment
Payment must be made in full, unless otherwise agreed.
Accepted methods: cash, bank transfer, or direct debit.
Receipts are provided only upon request.
Payments are non-refundable, but may be transferred with Trainer approval.
B. Direct Debit
Direct debit payments are governed by a separate Direct Debit Agreement.
C. Transfer Policy
Transfers require written request and consent from the transferee.
Financial arrangements between parties are the responsibility of the client.
D. Outstanding Balances & Expiry
Outstanding payments may be deducted from future purchases.
Unused sessions expire 12 months after purchase, with no extensions.
7. Liability & Acknowledgement of Risk
By participating in training activities with JMack Health you automatically agree to these Terms & Conditions and you acknowledge:
Participation is at your own risk.
You release Justin Mackellin (JMack Health), its agents, and representatives from any liability for accidental injury or illness.
You will disclose all injuries, impairments, or health limitations affecting your ability to train safely.
